Licence terms

Last updated: August 9, 2026. These terms govern all standard licences purchased through iiwatercolor.com. Exclusive agreements may include additional terms in writing.

1. Definitions

  • Licensor — the artist and rights holder behind II Watercolor (iiwatercolor.com).
  • Licensee — the individual or organisation purchasing a licence.
  • Artwork — the specific ink and/or watercolor image licensed.
  • Licence — the non-exclusive right to use the Artwork as described in the purchased tier and certificate.

2. Ownership

The Licensor retains full copyright and ownership of the Artwork. The Licensee purchases a licence to use the Artwork only — not ownership of the image, source file or underlying creative work.

3. Grant of licence

Upon full payment, the Licensor grants the Licensee a limited, non-transferable licence to use the Artwork according to the purchased tier (Personal/Decorative, Editorial/Web, Small Commercial, or Extended Commercial). Permitted uses are listed on the artwork page and in the PDF licence certificate.

4. Restrictions (all tiers unless otherwise agreed)

  • No resale, redistribution or sharing of the original high-resolution file
  • No sublicensing to third parties
  • No use in NFTs, blockchain assets or tokenised products without written permission
  • No use for AI training, machine learning datasets or model fine-tuning without written permission
  • No political, defamatory, pornographic, unlawful or harmful use
  • No use that misrepresents the Artwork as AI-generated or stock photography
  • No registration of the Artwork as a trademark or design without permission

5. Exclusivity

Standard licences are non-exclusive unless a separate Exclusive Licence Agreement is signed. Exclusive licences may include removal of the Artwork from the public catalogue for a defined sector, territory or duration.

6. Territory

Unless otherwise stated, licences are valid worldwide. The primary commercial focus is the United Kingdom and United States.

7. Duration

Licence duration depends on the tier purchased: 3 years, 5 years, or perpetual. Duration is stated on the licence certificate. After expiry, continued use requires renewal.

8. Attribution

Editorial and Small Commercial licences may require credit to the artist (e.g. “Artwork © II Watercolor”). Requirements are stated in the certificate. Extended Commercial licences may waive attribution where specified.

9. Delivery

High-resolution files are delivered via secure download link after payment. Links are time-limited and may have a maximum number of downloads. Watermarked previews on the website do not constitute licensed files.

10. Warranties

The Licensor warrants that they hold the rights to license the Artwork. The Artwork is provided “as is”. The Licensor is not liable for indirect or consequential damages arising from use.

11. Refunds

Because digital files are delivered immediately, refunds are generally not available once the high-resolution file has been downloaded. Contact us if you believe an error has occurred.

12. Governing law

These terms are governed by applicable law in the Licensor’s jurisdiction. Disputes should first be addressed by email to licensing@iiwatercolor.com.
